Preliminary remarks

Below we explain to what extent, for what purpose and when we collect, process and use personal data. Moreover we give an explanation of the way in which the services we offer function and inform you of how the protection of your personal data is guaranteed.

We collect, process and use personal data solely in the context of currently-valid legal regulations.

1. Name and contact details of the party responsible for the processing (controller)

2. Collection and storage of personal data and the form and purpose of their usage

a) When visiting our web presence (hereinafter referred to as the “website”)

When you visit our website www.schulwitz.de information is automatically sent to our website service by the browser used by your end device. This information is temporarily stored in a so-called log file. The following information is collected, without your taking any action, and stored until it is automatically erased:

  • IP address of the accessing computer
  • Date and time of access,
  • Name and URL of the requested file,
  • Website from which the access comes (Referrer-URL),
  • Browser used and possibly the operating system of your computer and name of your access provider.

We process the aforementioned data for the following purposes:

  • In order to ensure a smooth connection is established with the website
  • In order to guarantee convenient use of our website
  • For evaluation of the system security and stability, and
  • For other administrative purposes.

The legal basis for the processing of the data is article 6 paragraph 1 (1) lit. f GDPR. Our legitimate interest ensues from the purposes for data collected listed above. Under no circumstances do we use the data collected for the purposes of making inferences regarding you. We also use cookies and analytics services when you visit our website. You can find further information on this under section 4 and 5 of this data privacy statement.

b) When you contact us (e.g. using our contact form or by e-mail)

If you should contact our company, personal data are collected. In the event that you use the contact form provided on our website, the manner and scope of the data collected are clear from the contact form itself, and if you contact us in another way (e.g. by e-mail) you have, in the message you send, decided yourself in what form and to what extent you transmit data to us. The data are used exclusively for the purpose of processing your request and the related technical administration that is necessary for this. Data processing for the purpose of contacting us takes place in accordance with article 6 paragraph 1 (1) lit. a GDPR, on the basis of your freely given consent. The personal data we collect are automatically erased after the request you make to us is dealt with, provided the issue has been definitively clarified and no legal obligations to store them oppose this.

3. Transfer of data

Your personal data are not transferred to third parties except for the purposes stated below. We only pass your personal data on to third parties if:

  • You have given your express consent in accordance with article 6 paragraph 1 (1) lit. a GDPR,
  • The transfer is necessary in accordance with article 6 paragraph 1 (1) lit. f GDPR for the establishment, exercise or protection of legal claims and there are no grounds for assuming that you have an overriding interest which requires protection of your data and prevents the transfer thereof,
  • There is a legal obligation making the transfer necessary in accordance with article 6 paragraph 1 (1) lit. c GDPR, and
  • It is legally permissible and, in accordance with article 6 paragraph 1 (1) lit. b GDPR, is necessary for the performance of a contract with you.

4. Cookies

We use cookies on our website. Cookies are small files which your browser automatically creates and which are stored on your end device {PC, laptop, tablet, smartphone or similar) when you visit our page. Cookies do not cause any damage to your end device, and do not contain any viruses, Trojans or other malware. Information is recorded in the cookie which refers to the specific end device used. However, this does not mean that we obtain direct knowledge of your identity in this way. On the one hand, we use cookies to make our website more attractive for you. As a result we use so-called session cookies, in order to ascertain whether you have already visited individual pages of our website. These cookies are automatically deleted after you leave our site. And on the other hand we use temporary cookies that are stored for a specific period of time on your end device. If you visit our website again in order to utilise our services, the system will automatically recognise that you have already visited us and know which input and settings you have activated, so that you do not have to enter this information again. We also use cookies in order to record statistics on the use of our website and for the purpose of evaluating the optimisation of our services for you (see section 5). When you visit our website, these cookies enable us to automatically know if you have visited us before. These cookies are automatically erased after a set period. The data processed by cookies are necessary for the purposes stated, and for the safeguarding of our legitimate interests and those of third parties, in accordance with article 6 paragraph 1 (1) lit. f GDPR. Most browsers automatically accept cookies. However, you can set your browser in such a way that it will not store any cookies on your computer, or to always show a message before a new cookie is placed. Complete deactivation of cookies may however have the result that you are unable to use all the functions of our website.

5. Analytics tools

The tracking measures listed below, which we use, are employed on the basis of article 6 paragraph 1 (1) lit. f GDPR. In using future tracking measures, our aim is to guarantee an appropriate design and the continual optimisation of our website. Furthermore we use tracking measures in order to record statistics on usage of our website and for the purpose of evaluating the optimisation of the services we offer you. These interests are deemed legitimate in the meaning of the aforementioned provision. The respective purposes of the data processing and data categories can be inferred from the corresponding tracking tools.

Google Analytics

For the purpose of appropriate design and the continual optimisation of our website we use Google Analytics, a web analysis service of Google lnc. (https://www.google.de/intl/de/about/) (Gordon House, Barrow Street, Dublin 4, Irland; hereinafter “Google”). In this context, pseudonymised user profiles are created and cookies are used (see section 4).

The information produced by the cookie on your use of this website, such as

  • Browser type/version,
  • Operating system used,
  • Referrer URL (site visited previously),
  • Host name of the accessing computer {IP address),
  • Time of server request,

is transmitted to a Google server in the USA and stored there. The information is used to evaluate your use of the website, compile reports on website activities and provide other services associated to website and Internet usage for the purpose of market research and appropriate design of these web pages. This information is also transferred to third parties, if this is required by law or third parties are contracted to process these data. Under no circumstances will your IP address be merged with other data held by Google. The IP addresses are anonymised so that they cannot be associated to users (IP masking). You can set your browser to prevent the placing of cookies; however, we point out that if you do so, you may not be able to fully use all the functions of this website. You can also prevent the collection of the data generated by the cookie regarding your use of the website (including your IP address), and the processing of these data by Google, by downloading and installing a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=de).

We have concluded a contract for commissioned data processing with Google and implement the provisions of the German data protection authorities in our use of Google Analytics.

6. Presence in social media /social media

Our company is present on different social networks. In the context of a visit to them, personal data may possibly be transmitted to the provider of the social network in question. In doing so, in addition to the data on you that you entered, other personal data may be collected, processed or used by the respective social network.

In addition, certain data on your computer system corresponding to those named under section 2 are collected, processed and used by the social network. If you are logged in with your user data during a visit to such a social network, this visit can be attributed to you. If you do not wish this to happen, you should log out of your user account before visiting our presence there.

Please consult the type, purpose and scope of the data collection brought about by the respective network and your rights and further information at the current privacy provisions of the provider in question.

7. Retention period of data

Our company adheres to the principles of data reduction and data economy. As a result, we only store your personal data as long as is necessary to attain the purposes stated herein or as provided for by legal storage and retention periods. After cessation of the purpose in question or lapsing of these periods, the data in question are erased, routinely and in accordance with the legal regulations.

8. Data subject rights

You have the following rights:

  • in accordance with article 15 GDPR, you have the right to obtain information on the personal data concerning you. In particular, you can request information on the purposes of the processing, the categories of the personal data concerned, the categories of recipients to whom the personal data have been or will be disclosed, the envisaged storage period of the data, the existence of the right to rectification, erasure, restriction of processing or to object to processing, the existence of the right to lodge a complaint, the source of your data, if not collected by us, and the existence of automated decision-making, including profiling, as well as meaningful information about the details involved;
  • in accordance with article 16 GDPR, you have the right to obtain from us without undue delay the rectification of inaccurate personal data concerning you, or to have incomplete personal data completed;
  • in accordance with article 17 GDPR, you have the right to obtain from us the erasure of the personal data concerning you, provided the processing is not necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;
  • in accordance with article 18 GDPR, you have the right to obtain restriction of processing, if the accuracy of the personal data is contested by you, the processing is unlawful but you oppose the erasure and we no longer need the data, but you require them for the establishment, exercise or defence of legal claims, or you have objected to processing pursuant to article 21 GDPR;
  • in accordance with article 20 GDPR, you have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format and have the right to request transmission of the data to another controller;
  • in accordance with article 7 paragraph 3 GDPR, you have the right to withdraw your consent from us at any time. As a consequence, we may no longer carry out the data processing based on this consent in the future, and
  • in accordance with article 77 GDPR, you have the right to lodge a complaint with a supervisory authority. Generally speaking, to do so you can contact the supervisory authority of your place of residence or place of work or of our registered corporate address.

9. Right to object

If your personal data are processed on the basis of legitimate interests in accordance with article 6 paragraph 1 S. 1 lit. f GDPR, you have the right, in accordance with article 21 GDPR, to object to the processing of your personal data if there are grounds relating to your particular situation or the objection is against direct marketing. In the latter case, you have a general right to object, which will be implemented by us without your providing details of a particular situation. If you wish to make use of your right to withdraw consent or to object, it is sufficient to send an e-mail to t.schweiger@schulwitz.de.

10. Data security

During visits to the website we use the common SSL procedure (Secure Socket Layer) in combination with the highest encryption level supported by your browser. This is usually a 256 bit encryption. If your browser does not support a 256 bit encryption, we use 128 bit v3 technology instead. You can recognise whether an individual page of our website is transferred encrypted by the key or padlock symbol in the status bar of your browser. We also employ suitable technical and organisational security measures to protect your data against random or wilful manipulation, partial or total loss, destruction or unauthorised third-party access. Our security measures are continuously being improved in accordance with technological development.

11. Validity and changes to this data protection statement

This data protection statement is currently valid as of June 2018. It may become necessary to change this data protection statement due to further development of our website and offers, or because of changes in legal or official requirements.
